Brian Eftenoff''s case really demonstrates this country is stupid!

Brian killed his wife and got 22 years for that but the judge wasn't done. Since Brian sent a gram of cocaine through the mail the judge gave him 28 more years to be served in addition to 22 years for murder.

***????

Yes that's right a judge felt having cocaine is far worse than murder...

Can you think of other cases that are as screwed up as that?

The maximum penalty in Arizona for 2nd Degree Murder is 25 years. The judge was able to use the small cocaine charge in conjunction with Eftenoff''s four prior convictions to add a 28 year concurrent sentence so Eftenoff will serve 3 years more than the maximum.

The Judge did an excellent job in sentencing. Why Arizona has a 25 year cap on 2nd Degree Murder is something only the Con Nut Jobs can answer.

Yeah and that's part of my point... He should have got life for the murder and the judge should have never been able to sentence him to 28 years for the cocaine... That is a ridicules sentence.

It is the liberal lawyers who get the criminals off and complain about 'inequality' in sentencing. Try again.

We really need an overhaul of the court system when a murdered wife is less than having a gram of coke...

Thank You Ronald Reagan...

First of all Brian did not kill his wife I know for sure he was at the casino til morning the casino has him on video! Second of all Judy had a lot of expensive clothes. She worked at NeimanMarcus. He sent the clothes to south Dakota for her sister to wear a small amount of coke was in with her clothes cause she stored her"stash" in her pocket! I seen her put it there! Judys sister had a stroke and survived when she was young. I believe that judys autopsy will show she had a cerebrovascular abnormality that predisposed her to the stroke that killed her! All that ***** prosecuter cared about was winning his case he knew Brian didn't do it. I hope that "sob"pays for what he did! A judge should intervene when there is insufficient proof of the prosecutors case !! There's proof he didn't do it ! Video at the casino!!!

Don't worry I picked the kids version...

How a bill becomes a law.

The Bill Is Sent to the President

When a bill reaches the President, he has three choices. He can:

Sign and pass the bill—the bill becomes a law.

Refuse to sign, or veto, the bill—the bill is sent back to the U.S. House of Representatives, along with the President’s reasons for the veto. If the U.S. House of Representatives and the U.S. Senate still believe the bill should become a law, they can hold another vote on the bill. If two-thirds of the Representatives and Senators support the bill, the President’s veto is overridden and the bill becomes a law.

Do nothing (pocket veto)—if Congress is in session, the bill automatically becomes law after 10 days. If Congress is not in session, the bill does not become a law.

Oh that was not Reagan. Confiscation was done by a Democrat Congress. I wish people would remember Presidents do not do anything! Congress is where all laws are formed!

"This potential for abuse is compounded by the strong financial incentive that law enforcement has to make seizures--since they benefit directly from forfeited property. It was the passage of the Comprehensive Crime Control Act of 1984, part of the Reagan-era ramp-up in the war on drugs, that first made this possible. At a federal level, the law established two new forfeiture funds: one at the U.S. Department of Justice, which gets revenue from forfeitures done by agencies like the Drug Enforcement Agency and the Federal Bureau of Investigation, and another now run by the U.S. Treasury, which gets revenue from agencies like Customs and the Coast Guard. These funds could now be used for forfeiture-related expenses, payments to informants, prison building, equipment purchase, and other general law enforcement purposes."

I know... sorry to use facts...

Again you are not understanding our system of Government. Reagan did not do this. Congress did. He just enforces what Congress does!

Reagan pushed for it and then signed it into law...

Obviously you didn't! a President can only enforce what congress does no matter how much he pushes for it!

Seriously dude, I know that you have not read nor seen trial videos. Mr Eftenoff has serious prior criminal convictions, of which he had served time for. It was for this reason a heavier weighting was given the mailing of cocaine. Not to mention the reasoning and/or the timing of said mailings.

Making rash determinations from headlines are what makes this crazy, but that’s on you!

Your an idiot.  The judge certainly doesn't say or think that the coke charge is worse than the murder, he simply had a chance to overkill the guy because he had priors, and did so.  Good job by the judge
